Terms & Conditions — Calm Studio

These Terms & Conditions ("Terms") govern your use of Calm Studio, an app published by OmniVibe, LLC ("OmniVibe," "we," "us," or "our"). By downloading, installing, or using Calm Studio, you agree to these Terms. These Terms supplement, and should be read together with, our general End User License Agreement, which governs your license to use OmniVibe software generally.

License to Use

Subject to these Terms and our End User License Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Calm Studio on devices you own or control, for your own personal, non-commercial use.

Subscriptions & Purchases

Some features are available through a one-time purchase or auto-renewing subscription ("Pro"). Purchases are billed by, and subject to the terms of, the Apple App Store or Google Play. Auto- renewing subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel your subscription through your Apple ID or Google Play account settings — we cannot process cancellations or refunds directly. Refunds are subject to Apple's and Google's own refund policies.

Wellness Disclaimer

Calm Studio is a relaxation and ambience app. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical or mental health condition, and it is not a substitute for professional medical or mental health care. If you are experiencing a medical or mental health emergency, contact a qualified professional or emergency services in your area.

Acceptable Use

You agree not to misuse the app, attempt to reverse engineer or tamper with it, or use it in any way that violates applicable law.

Intellectual Property

Calm Studio, including its design, visuals, and code, is owned by OmniVibe, LLC and protected by copyright and other intellectual property laws. Nothing in these Terms transfers ownership of the app to you.

Disclaimer of Warranties

Calm Studio is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, OmniVibe, LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of Calm Studio. Our total liability for any claim relating to the app will not exceed the amount you paid us in the twelve months before the claim arose.

Termination

We may suspend or terminate your access to Calm Studio if you violate these Terms. You may stop using the app at any time by deleting it from your device.

Changes to These Terms

We may update these Terms from time to time. Continued use of Calm Studio after an update constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law principles.
